The information and outputs provided by the OEMPRO platform (the "Service"), operated by OEMPRO, LLC ("OEMPRO," "We," "Us," or "Our"), are for general informational and documentation-support purposes only. By using the Service You acknowledge and agree to the following.

Not professional, legal, or insurance advice

OEMPRO analyzes collision repair estimates against OEM repair information and industry data and surfaces operations a shop may be able to document and bill. OEMPRO is a software tool. It does not provide legal advice, insurance advice, claims adjusting, or professional repair-engineering services, and nothing in the Service should be relied on as a substitute for the independent professional judgment of a qualified technician, estimator, shop owner, or licensed professional.

You remain responsible for repair and billing decisions

You (the collision repair shop and its personnel) are solely responsible for inspecting the vehicle, determining the correct and safe repair procedures, deciding which operations to perform, and deciding what to include on any estimate, supplement, or invoice submitted to an insurer, customer, or other party. Any supplement, line item, citation, or recommendation produced by the Service is a suggestion to be reviewed and verified by You before use. You must independently confirm that each operation is appropriate for the specific vehicle, accurate, and compliant with applicable OEM procedures, manufacturer position statements, and law before relying on or submitting it.

No guarantee of payment or outcome

OEMPRO does not guarantee that any insurer, customer, or third party will accept, approve, or pay for any operation, supplement, or amount identified by the Service. Reimbursement decisions are made by insurers and other parties outside Our control, and depend on factors including the policy, the jurisdiction, the documentation You provide, and the negotiation between You and the paying party. Past results do not guarantee future outcomes.

Accuracy of data and third-party sources

The Service draws on OEM repair information, position statements, industry data, and third-party sources that may change, be incomplete, or contain errors. We work to keep the data current and accurate but make no representation or warranty, express or implied, as to the completeness, accuracy, reliability, or suitability of any information provided by the Service. OEM names, logos, and marks referenced in the Service belong to their respective owners and are used to identify the source of repair information; their use does not imply endorsement of or affiliation with OEMPRO.

We learn from and reuse the data You submit

OEMPRO is a data-driven Service that continuously improves. You acknowledge and agree that the data You submit — including estimates, VINs, vehicle information, line items, notes, and the analysis outputs generated from them — may be collected, stored, retained, analyzed, de-identified, aggregated, and reused by OEMPRO for any purpose, including to operate, train, develop, and improve Our artificial-intelligence and machine-learning models, to build new products and features, and for benchmarking, analytics, research, and industry reporting. The specific rights You grant Us in Your data are set out in Our Terms and Conditions and the applicable Customer Subscription Agreement, and You should not submit any data You are not authorized to share on those terms.

Assumption of risk

You assume all risk arising from Your access to and use of the Service and any reliance on its outputs. You are a professional business user and are capable of independently evaluating the Service and exercising professional judgment. To the fullest extent permitted by law, You waive and release OEMPRO from any claim that the Service, its outputs, or the data it relies on caused or contributed to any loss, denied or reduced claim, repair error, or other harm.

Referral program

Any OEMPRO referral program is offered only to Customers with an active, paid subscription in good standing. Shops using the free estimate, a free tier, or a trial, and shops with no current paid subscription or whose subscription is past due, suspended, expired, or cancelled, are not eligible to refer other businesses or to earn referral rewards. Referral rewards are provided solely as account credit toward Your OEMPRO subscription, have no cash value, and may be withheld, reduced, reversed, or voided in cases of refund, chargeback, cancellation, self-referral, fraud, or abuse. We may modify, suspend, or discontinue the referral program at any time. The full referral terms are set out in Our Terms and Conditions.

Limitation of liability

To the fullest extent permitted by law, OEMPRO and its owners, members, managers, employees, agents, contractors, and affiliates will not be liable for any loss or damage (including lost revenue, denied or reduced claims, repair errors, or any direct, indirect, incidental, consequential, exemplary, or punitive damages) arising out of or in connection with Your use of, or reliance on, the Service or its outputs, regardless of the theory of liability and even if advised of the possibility of such damages. Your use of the Service is at Your own risk. This Disclaimer is in addition to, and does not limit, the disclaimers and limitations of liability in Our Terms and Conditions and any applicable subscription agreement.
